Kyle Sandilands, Jackie O Henderson fight: Sandilands ‘preparing to sue’ ARN if he’s fired, per report

Amid predictions Kyle Sandilands will be “back on the air as soon as possible”, it’s been claimed the radio host is preparing to sue if he’s fired by employer ARN.

According to The Sydney Morning Herald, sources at the media company say the broadcaster “will not take this lying down” if his 14-day suspension results in him losing his job.

ARN, which owns KIIS FM, suspended Sandilands on Monday for an alleged “act of serious misconduct” following an on-air clash with co-host Jackie ‘O’ Henderson on February 20 that led to her exit from The Kyle and Jackie O Show.

One employee told The Sydney Morning Herald the shock jock will “definitely sue” if his role is terminated.

“The agreement with ARN acknowledges the type of performer Kyle is: that he’s robust and a maverick-type character, and that’s something ARN has traded on for many years and gotten a lot of success out of,” they added.

“Kyle’s lawyers are also relying on the agreement he has with ARN that makes numerous mentions of his broadcasting style.”

This view was echoed by media and entertainment law expert Shaun Miller, who told the publication there is precedent for his on-air behaviour not being treated as an offense: “The radio station actually encourages him to be controversial because it’s part of his brand value.”

ARN’s statement on Monday revealed Henderson had left the pair’s hit show, giving notice she “cannot continue to work with” Sandilands, her co-host of 27 years.

The company has offered her the possibility of an alternative show on its network.

“ARN has also provided written notice to Mr Kyle Sandilands and Quasar Media Services Pty Ltd (Quasar Media) stating that it considers that Mr Sandilands’ behaviour during the show on 20 February 2026 is an act of serious misconduct which is in breach of ARN’s services agreement with Quasar Media, under which Mr Sandilands presents the Kyle and Jackie O show,” the statement continued.

Sandilands has been given 14 days to remedy the alleged breach, with the show taken off air in the meantime.

If he fails to do so, “ARN will terminate the services agreement with Quasar Media, and in that event Mr Sandilands wil cease to present the Kyle and Jackie O show,” the company said.

Speaking on 3AW yesterday, entertainment journalist Peter Ford echoed the view Sandilands will likely take legal action if ARN doesn’t put him back on air.

The host “will absolutely go for unfair dismissal” in that situation, Ford claimed, adding that “Jackie is certainly planning to go after them for being in an unsafe workplace.”

However, Ford says Sandilands “may be able [to] get back on air with a reduced pay packet” following his suspension.

“People dancing on [Sandilands’] grave may be just a little bit too premature,” he added.

Wade Kingsley, radio executive and host of The Quarter Hour podcast, said he can’t imagine a world where Sandilands isn’t on air – whether that’s with ARN or elsewhere.

“He was born a broadcaster so I think any way that gets him back on the air as soon as possible, whether it’s with his current company or another one, I think that will happen,” Kingsley told Today yesterday.
