Kroy Biermann Jr‘s lawyer is firing back HARD at claims that prosecutors made on Friday during a bond hearing involving his 15-year-old client — namely, the allegation prosecutors dropped in court that KJ supposedly had videos on his phone showing him having sex with an underage family member.
Jason Sheffield is the man who represents Kim Zolciak‘s son in the ongoing legal case regarding a sexual battery accusation in which, during a bond hearing, was where this incest claim came from prosecutors on Friday.

But now, after the incest allegation went ’round the world virally on Friday morning, Sheffield is now working to correct what he says is the actual record on that and make clear what he claims is actually going on.
Speaking to TMZ later on Friday, Sheffield started by discussing the incest aspect specifically, by noting:
“The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case.”
And in addressing the actual, specific purported incest videos themselves, Sheffield said:
“The matter arose from inappropriate, crude behavior involving two middle-schoolers.”

As we’ve reported, prosecutors claimed to the judge on Friday that the alleged videos supposedly showed the Real Housewives of Atlanta star’s son using “predatory, derogatory” language toward the relative during what was described in court as penetrative sex. Kroy Jr was charged with sexual battery of a victim under the age of 16 at the time, and the case was handled in juvenile court — which is why it was not reported on then, and why it’s only come to light right now, FYI.
Prosecutors also noted that the teenager has since been under court supervision because of that charge since October 2025.
Regardless, Sheffield tried to put the previous case into context, saying:
“[The prior case] did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense. Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”
FWIW, Sheffield said that he has not seen the evidence from the previous case, but based on his point of view from what he’s been told, he said that the video shows “more ridiculous, raunchy behavior” which is “boundary crossing inappropriate,” rather than what prosecutors are trying to make it seem like.
Sheffield said that issue ended up resulting in group counseling and reunification, by the way.
